Summary of Key Covenants/Restrictions

Requirements:

  • Mailboxes of same size, type & color
  • Yard light with electric photo cell
  • Owner shall keep lot reasonably free of unsightly growth and weeds
  • For those on the Wintercove North Pond-maintenance of the lot down to the water is required
  • Rubbish, garbage and/or waste shall be kept in a sanitary container out of public view
  • Pets must be confined to owners lot(s)

Prohibitions - not allowed

  • Vinyl, aluminum & Masonite siding
  • Above ground storage tanks (except for gas grills)
  • Out building and sheds
  • Electric bug zappers
  • Tennis courts
  • Corner lots-fencing, free standing walls, hedge or shrub plantings that obstruct sight lines (see additional detail)
  • Lots used as dumping grounds
  • Livestock and poultry (household pets are OK)
  • Outside burning
  • Exterior lights between building or rear lot shining upon another lot
  • Parking on cul-de-sacs
  • Certain vehicle parking-boats, campers, motor homes, trucks larger than one ton stored overnight in public view
  • Nuisances - "noxious or offensive activity" including barking dogs

Bluestone/Wintercove Covenants and Restrictions

As related to Section 14, ARCHITECTURAL CONTROL (e) Guidelines and Standards, we have the power to modify the guidelines and standards, as long as they are not in conflict with specific provision of the declarations.

Our intent is not to change the document as it is to try to interpret them and set some guidelines for their use.

Since all lots are currently build on or owned, "Section 13 (C) Changes in Conditions" the following areas now become standards:

  1. Repainting the same color of the Exterior of your home doesn't need approval.
  2. Repair of Maintenance of your Exterior of your home doesn't need approval
  3. Removing a Dead Existing Tree / Shrub and replacing does not need approval.
  4. Any Landscaping withing 5 ft of home doesn't need approval.
  5. The sentence "plantings, does not include flowers, bushes, Shrubs or other plants having a height of less than 30"tall.  (30" refers to mature heights) . . . .So if less than 30" mature height does not need approval.
  6. Landscaping improvements are to be:  Terraces, retaining walls, unusual vegetation coverings, Walks, Bank treatment, detached patios, Cabanas, hot tubs.  With respect to these improvements, Architectural review shall be submitted prior to starting of a project.

Section 10, Maintenance of lots, Recreation and outdoor structures:

  1. Seasonal and celebration display . . . Does not need Architectural review. . . We assume they will be taken down in some timely matter
  2. Although Recreation isn't talked about in Section 10. . . Recreational Equipment is mentioned in Section 13, (C). . requiring approval.
  3. Children's play Equipment:  such as sandboxes, temporary swimming pools (depth less than 24'), Swing and slide sets, playhouse shall not require review if less than 7 ft tall, and maintained in good repair, with every reasonable effort to shield or screen equipment from view and to shield or soften effects of sound with regard of adjunct home owners.  Taller than 7' does need approval
  4. Exterior Lighting . . .Exterior lighting is encouraged for decorative and security reasons.  All exterior lighting shall be directed so as not to create annoyance to adjunct home owners.  Wall mounted (HID) will not be permitted.  Fixtures greater than 40 watts withing setbacks would require approval.

ARCHITECTURAL REVIEW COMMITTEE COMMENTS

A.  Add no outside burning with the exception of recreational fire pits

B.  Would also like something added as in the guidelines about lot maintenance weed control, mowing removal of trash and debris, fencing, and outside structures.  Pear trees trimmed so they do not encroach on sidewalks (something like that)

C.  Under prohibitions no permanent parking on cul-de-sacs right now it is no parking on cul-de-sacs.

D.  Children's play equipment (I think) still needs to be approved.  We don't want anything fewer than 7 feet that would open a big can of worms, and we don't allow play houses to be build to much like a shed.  So, I want number 3 reconsidered under Lots and Recreation

E.  4. . .Weeks at a maximum). . . Seasonal Displays taken down.
